1. CONTEST PERIOD: The contest begins on September 7, 2012 at 12:00:00 AM ET and ends December 31, 2012 at 11:59:59 PM ET (the "Contest Period"). Only entries received during the Contest Period are eligible to participate in this Contest.
2. ELIGIBILITY: This Contest is open to all legal residents of Canada, who are over the age of thirteen (13) at the time of Contest entry, except employees (and members of the immediate families and households of such employees) of Nestlé Canada Inc. (the “Sponsor”), its affiliated corporations, its suppliers, distributors and advertising or promotional agencies who are involved in this contest and all of their respective directors, officers, partners and employees (collectively, the Sponsor and such others, the "Releasees"). In these Contest Rules, “immediate family” means in relation to any person, that person’s parents, children, siblings and spouse. Entry forms shall be subject to verification and shall be null and void if they are found to not have been submitted in accordance with these Contest Rules.
3. HOW TO ENTER: To enter the Wonderfur Winter Contest (the “Contest”) you must first register your cat or dog into the Wonderfur Winter Contest by completing the online registration form and uploading a photograph* of your cat or dog at www.wonderfurwinter.ca (the “Contest Website”). To complete the online registration form you must include your name (first and last name), email address, create a Password and click “Submit”. To enter a pet into the Contest, you must be logged in to the Contest Website or log-in, by using your email and Password created at time of Registration, and create a Pet Profile by doing the following: upload a picture of your pet, agree to accept all Terms & Conditions, indicate pet species as “Cat” or “Dog”, provide your Cat’s or Dog’s name and the city in which you reside. Once you fully complete the Pet Profile and click the “Submit” button, you will be automatically entered into the next available Voting Period (see rule 5 below). NO PURCHASE NECESSARY.
   
   *All photographs submitted to the Contest must follow these standards for submission: File format: JPG, GIF, PNG or BMP - maximum 10MB file size. Entrants (or your parent/legal guardian if you are under the age of majority in your jurisdiction of residence) submitting a photograph must be the owner of the pet shown and the photograph submitted. If the entrant is not the owner of all rights to the photograph submitted, the entry will be disqualified. Photographs must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement. If a photograph depicts any person(s) other than the Entrant in a way that such person(s) can be recognized, the Entrant (or your parent/legal guardian if you are under the age of majority in your jurisdiction of residence) must get a written approval from the person(s) shown in the photograph. The Sponsor will not be held responsible for any claims against infringement of rights to an image or right to privacy by the photograph submitted. Photographs displaying trade-marks, trade-names, protected designs, copyrighted materials or other written information on them as well as pictures with advertisements will be disqualified from the Contest. Photos that demonstrate any of the following will be removed: animal cruelty, an animal showing any sign of stress, any visible modifications or enhancements, offensive behavior or language, duplicates of an existing photograph. Photographs that do not meet exposure quality standards may be removed at the sole discretion of the Sponsor.
4. GRAND PRIZES: There are a total of two (2) Grand Prizes available to be won at the outset of the Contest. Each Grand Prize consists of a photo session** of the winning, (see rule 5 below) pet (one (1) cat and one (1) dog), that will be featured on the 2013 Wonderfur Winter gift packs.
   
   **Each entrant who submits a photograph agrees that if his or her cat or dog is selected by the Judging Panel to be featured on the 2013 Wonderfur Winter gift pack, then he or she will make his or her cat or dog available for a photo session for that purpose and that all such photographs taken shall be the property of the Sponsor all without payment of any fee or other compensation.
   
   Each Grand Prize must be accepted as described in these rules and cannot be transferred to another person, substituted for another prize, or exchanged in whole or in part, for cash, subject to the provisions set forth elsewhere in these rules. Any difference between the actual value of a Grand Prize and approximated value stated in these Contest Rules will not be awarded. Unclaimed prizes will not be awarded.
5. CONTEST VOTING PERIODS:
   
   Voting Period 1 begins September 7, 2012 at 12:00:00 AM ET and ends October 12, 2012 at 11:59:59 PM ET.
   
   Voting Period 2 begins October 13, 2012 at 12:00:00 AM ET and ends November 23, 2012 at 11:59:59 PM ET.
   
   Voting Period 3 begins November 24, 2012 at 12:00:00 AM ET and ends December 31, 2012 at 11:59:59 PM ET.
   
   Grand Prize Voting: At the conclusion of each Voting Period, the three (3) cat entries and three (3) dog entries, who have received the greatest number of votes***, will be declared as Finalists and be eligible for judging by the Judging Panel**** at the conclusion of the Contest Period. After the conclusion of each Voting Period, the number of votes each cat and dog has received will be re-set to zero and the voting tabulation will start over again. Any cat entry or dog entry that has been declared a Finalist from a previous Voting Period will not be eligible to be declared as a Finalist for a subsequent Voting Period. If for any Voting Period there is a tie in the number of votes for the third place entry, the Judging Panel will select the winning entry based upon the quality of the photographs submitted as part of the tied entries.
   
   At the conclusion of the Contest Period photographs of the nine (9) cat Finalists and nine (9) dog Finalists will be reviewed by the Judging Panel. The Judging Panel will, in its sole discretion, select one (1) dog Finalist and one (1) cat Finalist that will be the Grand Prize winners.
   
   ***In order to ensure a fair and equitable competition, the Sponsor reserves the right to impose voting limits on the number of votes that may be cast from any IP address. Voting limits may be imposed by the Sponsor, at any time and for any Voting Period, in its sole and absolute discretion. The Sponsor shall not be required to announce or otherwise provide notice of its decision to impose voting limits. Any voting limits established by the Sponsor will be applied consistently for any Voting Period.
   
   ****The Judging Panel consisting of representatives of the Sponsor and their advertising agency, as determined by the Sponsor, who will judge the entries based on a combination of the following judging criteria; creativeness of photograph submitted and number of votes the pet has received.
   
   No communication will be entered into except with the selected entrants. No responsibility is assumed by the Sponsor for any inability of a potential entrant to successfully enter for any reason.
6. HOW TO CLAIM A PRIZE: Before being declared a winner, and in order to receive a Grand Prize, a potential winner (or your parent/legal guardian if you are under the age of majority in your jurisdiction of residence) will be required to accept the terms of a Declaration and complete a Release and Waiver form WITHIN 7 DAYS FROM THE DATE NOTIFICATION WAS SENT TO THE POTENTIAL WINNER or the Grand Prize will be forfeited, potential winner disqualified and a replacement winner may be selected at Sponsor’s discretion. Each entrant under the age of majority must have the consent of his/her parent or legal guardian to submit his/her personal information in order to enter the Contest. The parent or legal guardian must complete all the required fields on the relevant portion of the Entry Form, including his/her name and address. If a parent or legal guardian does not provide consent, the entry will be disqualified. The decision of the Contest Judges in respect of all matters pertaining to the Contest, including without limitation, eligibility, validity, contents, and/or disqualification of an entry, shall be final and binding without right of appeal. Awarding of the Prizes is subject to verification and compliance with these Contest Rules.
7. NO PURCHASE NECESSARY: Purchase is not required and does not enhance a person’s chance of winning.

CONDITIONS OF ENTRY:


8. By participating in this Contest, each entrant (i) agrees to comply with these Contest Rules including all eligibility requirements and, (ii) agrees to be bound by the decisions of the Contest Judges, which decisions shall be made by the Contest Judges in their sole discretion and which decisions shall be final and binding in all matters relating to this Contest. Entrants who have not complied with these Contest Rules are subject to disqualification. Entries become the property of the Sponsor, including all intellectual property rights in all photographs submitted. All entrants irrevocably agree that by submitting a photograph, he or she transfers and assigns all right, title and interest in the photograph to the Sponsor. Each entrant further agrees to waive all moral rights in the photograph submitted in this Contest. The Sponsor reserves its unlimited right to display the photographs in any form of media, including, without limitation, newspaper, Internet websites, and/or television. The Sponsor reserves its unlimited right to edit or manipulate the photographs for purposes of better editorial display. The Sponsor is not liable for the inclusion of any third-party trademarks or other intellectual property by the entrant.
9. The Sponsor is not responsible for late, lost, damaged, misdirected, mutilated, garbled, illegible or incomplete entries. Proof of transmission (screenshots, etc.) does not constitute proof of delivery. All entries become the property of the Sponsor and in no case shall be returned to sender.
10. The Sponsor reserves the right to prohibit an entrant from participating in the Contest or winning a prize, if, in the sole discretion of the Sponsor, the Sponsor determines that the entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse or threaten or harass any other entrants or the Sponsor. The Sponsor reserves the right to disqualify any entrant failing to comply with these Contest Rules or cooperate in any investigation or inquiry concerning such compliance. Any attempt, by an entrant or other individual, to deliberately damage any website or to undermine the legitimate operation of this Contest, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek remedies and damages from any such individual to the fullest extent permitted by law. Participant engaging in any of the foregoing activities may be disqualified and will forfeit any prizes won. The Sponsor reserves the unfettered right, in their sole and absolute discretion, to disqualify any entries that they suspects were generated by script, macro, robotic, programmed, or any other automated means, or otherwise violate the Contest Rules.
11. If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address provided at time of entry. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access or online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
12. Entrants and/or winners assume liability for injuries caused, or claimed to be caused by participating in the Contest, by the acceptance, possession, or use of any prize awarded, including but not limited to claims/damages for personal injury, or property damage.
13. RESIDENTS OF QUEBEC: Subject to the approval of the Régie des alcools des courses et des jeux du Québec the Contest Sponsor reserves the right to withdraw or terminate this Contest at any time without prior notice or obligation, subject to applicable laws. Any litigation regarding the conduct reorganization of a publicity contest may be submitted to the Régie des alcools des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
14. POTENTIAL WINNERS: If a potential winner is found to be ineligible, declines to accept the Grand Prize, or fails to accept, complete and return a Declaration and complete Release and Waiver form, or in the event that a prize confirmation or prize is returned undeliverable, the potential winner will forfeit his/her entitlement to the prize, and the Sponsor may select an alternate winner at its sole discretion. Potential winners (or parent or legal guardian as applicable), may be required to furnish proof of identification that may include a driver’s license or other form of picture identification. By accepting a Grand Prize, the winner of such Grand Prize consents to the use of his or her name, address, voice, statements relating to the Contest or the Sponsor, and photographs or other likenesses, without further compensation, in any publicity carried out by the Sponsor or any related entities in connection with this Contest, except where prohibited by law.
15. Any entry, or any other materials used in the Contest that have been tampered with, altered, reproduced, stolen, transferred, bartered, traded or auctioned (including but not limited to an online internet auction site), unissued, unauthorized, or not legitimately obtained, or which contain or reflect any error, will be void.
16. The Sponsor and the other Releasees are not responsible for any problems that may arise, including but not limited to, technical malfunctions of telephone network lines, computer online systems, servers or providers, computer equipment or software, viruses, bugs, failure of personal computers and/or software and hardware configurations, or failure of any email to be received by the Sponsors or a participant for any reason including but not limited to traffic congestion on the Internet or at any website or combination thereof. The Sponsor and the other Releasees are not responsible for damage to a user's system occasioned by participation in this Contest or downloading any information necessary to participate in this Contest.
    
    No responsibility is assumed by the Sponsor for any postal mail or overnight delivery returned as undeliverable without a forwarding address. No P.O. Box addresses will be accepted as a valid delivery address. No responsibility is assumed by the Sponsor for Prizes after they have been shipped. The Sponsor makes no representations or warranties of any kind concerning the appearance, safety or performance of any Prize. Winners bear all risk of loss or damages to Prizes after delivery.
17. The Sponsor and the other Releasees do not warrant that access to or use of the Contest will be uninterrupted or error-free.

DISCLOSURES:


18. The Sponsor reserves the right in its sole discretion to terminate the Contest in whole or in part, without notice, or to modify or suspend the Contest at any time subject to the approval of the Régie, if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or communications or any other errors or other causes beyond the control of the Sponsor corrupt the administration, integrity or security of the Contest or if any other factor interferes with the conduct of this Contest as contemplated by these Contest Rules. Without restricting the generality of the foregoing, and subject to the approval of the Régie, if for any reason more entrants receive a “win” notice than the number of prizes stated herein, the Sponsor reserves the right, in their sole discretion, to terminate the Contest in whole or part, or amend or suspend it and award only the number of prizes stated in these Contest Rules via a random drawing for the prizes not yet distributed at the time the Contest is terminated, suspended or amended. In no event will the number of prizes awarded exceed the available number of prizes as specified in these Contest Rules.
19. This Contest is subject to all Federal, Provincial, and Municipal laws. All entries become the property of the Sponsors and no correspondence will be entered into except with selected participants who will be contacted by mail, phone or by email. By entering the Contest, participants consent to the use of their name and/or photograph in any publicity carried out by the Sponsor or their agents without compensation. VOID WHERE PROHIBITED BY LAW.
20. In the event of any discrepancies between the English language rules and the non-English language rules, the English rules shall prevail.
21. All issues and questions concerning the construction, validity, interpretation and enforceability of these Contest Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.
22. Unless entrants otherwise indicated, the personal information gathered about entrants in the course of this Contest will be used solely by the Sponsor and solely for the administration of the Contest and in connection with any publicity relating to the Contest.
